Overall, Samsung wants a 2.4 percent royalty on every infringing Apple device sold ? a figure that could translate to a sizable payday for Samsung.

So far, Samsung hasn?t been faring very well in the pre-trial action. Perhaps the most damaging elements to date have been Judge Koh?s decision to grant a preliminary injunction barring sale of the Galaxy Tab 10.1 in the United States and a temporary injunction on sales of the Samsung?s Google-branded Galaxy Nexus. The Galaxy Tab 10.1 injunction is too little too late since the Galaxy Tab 10.1 is at the end of its life cycle, but from a legal point of view the injunction is significant: Judge Koh was convinced that, even before the trail, the evidence that Samsung?s tablet infringed on Apple?s iPad was persuasive enough to pull the product from the market.

The Galaxy Nexus ban is more substantial. Although it was introduced last year, it?s still Google?s flagship Android phone. Judge Koh found that the device violates an Apple patent on a ?universal interface? for search. (The patent is widely interpreted as applying to Apple?s Siri voice-activated interface, but the filing actually predates Apple?s acquisition of Siri.) Koh was convinced pre-trial that Apple was being harmed by Galaxy Nexus sales, finding that Apple was likely to ?lose substantial market share in the smartphone market and to lose substantial downstream sales of future smartphone purchases and tag-along products.?

Judge Koh has also limited the types of material that Samsung can present at trial. For instance, Samsung has been barred from presenting quotes from Steve Jobs? authorized biography, in which the late Apple CEO asserts ?I?m going to destroy Android, because it?s a stolen product.? And Samsung?s assertions that Apple based the iPhone design on Walkman concepts? Judge Koh has ruled Samsung can?t present that information either, thanks to Apple revealing so-called ?Purple? concepts from 2005 that predate Sony?s designs.

None of this is good news for Samsung, but it gets worse: The jury will hear that Samsung failed to live up to its discovery obligations and ?failed to prevent the destruction of relevant evidence.? That assertion doesn?t quite rise to the level of willfully destroying evidence, but the court has found that evidence relevant to the trial was destroyed by Samsung after it should have been clear to the company that it should be preserved for litigation. The jury will be free to decide on its own whether it?s relevant, but may assume the destroyed evidence was favorable to Apple.

But it?s not as if there?s any lack of written material to present: at last count, discovery documents for the case totalled nearly 40 million pages ? and Apple plans to cite internal Samsung documents with assertions its smartphone design ?copied the iPhone too much,? along with an analysis done for Samsung that found its Galaxy S phone was ?too iPhone-like? and strongly aped the iPhone user interface.

QIDONG, China (Reuters) - Angry demonstrators occupied a government office in eastern China on Saturday, destroying computers and overturning cars in a violent protest against an industrial waste pipeline they said would poison their coastal waters.

The demonstration was the latest in a string of protests sparked by fears of environmental degradation and highlights the social tensions the government in Beijing faces as it approaches a leadership transition this year.

About 1,000 protesters marched through the coastal city of Qidong, about one hour north of Shanghai by car, shouting slogans against the plan pipeline that would empty waste from a paper factory in a nearby town into the sea.

Demonstrators rejected the government's stand that waste from the factory would not pollute the coastal waters.

"The government says the waste will not pollute the sea, but if that's true, then why don't they dump it into Yangtze River?" said Lu Shuai, a 25-year-old protester who works in logistics.

"It is because if they dump it into the river, it will have an impact on people in Shanghai and people in Shanghai will oppose it."

Several protesters entered the city government's main building and were seen smashing computers, overturning desks and throwing documents out the windows to loud cheers from the crowd.

Reuters witnessed five cars and one minibus being overturned. Over 1,000 police - some paramilitary - guarded the city government office compound in lines.

At least two police officers were dragged into the crowd at the government office and punched and beaten enough to make them bleed.

On Friday, in an effort to stave off the protest, the Qidong city government announced it would suspend the project for further research.

But many protesters said on Saturday that postponement was not enough.

"If the government really wanted to stop this project, they should have done it right from the beginning. At this point they are too late," said Xi Feng, a 17-year-old protester.

Local officials took steps to ward off the demonstration and residents received text messages and letters warning that any public demonstration would be illegal.

Environmental worries have stoked calls for expanded rights for citizens and greater consultation in the tightly controlled one-party state.

The outpouring of public anger is emblematic of the rising discontent facing Chinese leaders, who are obsessed with maintaining stability and struggling to balance growth with rising public anger over environmental threats.

The protest followed similar demonstrations against projects the Sichuan town of Shifang earlier this month and in the cities of Dalian in the northeast and Haimen in southern Guangdong province in the past year.

In Shifang, the government halted construction of a copper refinery following protests by residents that it would poison them. It also freed most of the people who were detained after a clash with police.

The leadership has vowed to clean up China's skies and waterways and increasingly tried to appear responsive to complaints about pollution. But environmental disputes pit citizens against local officials whose aim is to lure fresh investment and revenue into their areas.

The International Olympic Committee had declined a request to hold a moment of silence during the ceremony to acknowledge the 11 Israeli athletes and coaches killed by Palestinian gunman in Munich in 1972. Costas called that decision insensitive during an interview this month and indicated he would call for his own moment of silence when Israeli athletes marched into the Olympic Stadium Friday.

Costas' comments took his bosses by surprise. Jim Bell, executive producer of the NBC's telecast, said this week that Costas hadn't brought it up with him before the interview.

As the athletes marched in Friday, Costas said that IOC President Jacques Rogge led a moment of silence for the late Israelis this week before about 100 people at the Athlete's Village.

"Still, for many, tonight with the world watching is the true time and place to remember those who were lost and how and why they died," Costas said.

After a five-second pause, NBC cut to a commercial.

Hundreds celebrate rare white bison at Conn. farm

GOSHEN, Conn. (AP) ? Dozens of Native Americans wore the traditional garb of their ancestors, sang songs and beat drums on a western Connecticut farm Saturday in celebration of the birth of one of the world's rarest animals ? a white bison.

The miracle calf was officially named Yellow Medicine Dancing Boy at the elaborate ceremony at the Mohawk Bison farm in Goshen in the state's northwestern hills. It was born June 16 at the farm of fourth-generation farmer Peter Fay.

Many Native Americans consider white bison a symbol of hope and unity; some consider their births sacred events. Experts say white bison are as rare as one in 10 million.

Yellow Medicine Dancing Boy is not an albino, and Fay said DNA testing confirmed the animal's bloodlines are pure and there was no intermingling with cattle.

Lakota tribe members from South Dakota were among the hundreds of people who gathered at the celebration. Other tribal elders from the Mohawk, Seneca and Cayuga tribes participated.

Crowds patiently waited by the roadside before slowly marching into the pasture and lining up alongside a fence as the ceremony began. Children squeezed up against their parents and peered through the fence.

Some women were dressed in colorful tunics and other items indigenous to Native American culture, including bracelets, feathers and boots. Men also wore traditional costumes. Those leading the ceremony wore plain and small headdresses.

Fay, 53, runs the farm below Mohawk Mountain and invited Native Americans to the event, which also included a feast and talks by tribe elders.

"I'm almost like the calf to them because I'm the caregiver. They've been here almost every day, teaching me," said Fay, who has a herd of bison tattooed on his right shoulder.

Fay attended a sweat lodge ceremony with the elders on Friday night in Cornwall. The nearly two-hour ceremony was a way to repair damage done to their spirits, minds and bodies. It acted as a prayer for a name for the calf to come to them through the spirits.

Saturday's ceremony was held under an arbor next to a large fire, amid thunder and large dark rain clouds. Marian and Chubb White Mouse, members of the Oglala Lakota tribe in South Dakota, traveled to Goshen from Wanblee, S.D., to lead the ceremony.

Marian White Mouse told the crowd the birth of a white bison is a sign from a prophet, the White Buffalo Calf Woman, who helped them endure times of strife and famine.

"We come with one prayer, one heart and one mind," she said tearfully. "This is truly a miracle. I hope that this one prayer will keep my people together, keep all of us together."

Barbara Threecrow, an elder from the Naticoke tribe who lives in Hudson Valley, N.Y., sat holding a sacred Canupa of beaver skin containing a pipe.

"I believe this is an awakening," Threecrow said. "This is a way of telling people to remember the sacredness of all of life."

(AP) ? AIDS is graying. By the end of the decade, the government estimates, more than half of Americans living with HIV will be over 50. Even in developing countries, more people with the AIDS virus are surviving to middle age and beyond.

That's good news ? but it's also a challenge. There's growing evidence that people who have spent decades battling the virus may be aging prematurely. At the International AIDS Conference this week, numerous studies are examining how heart disease, thinning bones and a list of other health problems typically seen in the senior years seem to hit many people with HIV when they're only in their 50s.

"I'm 54, but I feel older," said Carolyn Massey of Laurel, Md., who has lived with HIV for nearly 20 years.

"When I hear young people talk about, 'Well you get HIV and you take your drugs and you'll be all right' ? that's just not the truth," she said. "This is a lifelong thing we're talking about, and it unfolds every day on you."

The graying isn't just because people like Massey are surviving longer. Some of it comes from older adults being newly diagnosed, a trend U.S. health officials say is small but slowly growing. Yes, grandparents still have sex ? and that's an age group missed by all those hip safe-sex messages aimed at teens and 20-somethings.

"They let down their guard," is how Dr. Kevin Fenton of the Centers for Disease Control and Prevention puts it.

Already, a third of the nearly 1.2 million people living with HIV in the U.S. are over 50, and by 2020 half will be, Fenton said at one of numerous sessions on aging at the world's largest AIDS meeting.

People 50 or older accounted for 17 percent of new HIV diagnoses in 2009, according to the CDC's latest data. That's up from 13 percent in 2001.

There aren't as good counts in poor regions of the world, where access to life-saving medications came years later than in developed countries.

But even in hard-hit sub-Saharan Africa, home to most of world's HIV-infected population, studies suggest 3 million people living with HIV are 50-plus, said Dr. Joel Negin of the University of Sydney in Australia. By 2040, he said, that could reach 9 million.

There, challenges are different. Ruth Waryaro of Kenya, addressing the conference on her 65th birthday, said clinic workers hassle her when she goes to pick up her monthly supply of medication ? not believing a grandmother really needs it.

"If you're not strong enough, you just leave the medication and go home," said Waryaro, who raised four children of her own and now is raising four AIDS orphans. She also has diabetes and high blood pressure.

As Negin pointedly told the conference, "50 is not old." But for years, world health authorities didn't even measure HIV in people beyond age 49.

Today, people who are diagnosed and treated early can expect a near-normal life-span, Dr. Anthony Fauci, infectious disease chief at the National Institutes of Health, told The Associated Press.

The new focus is on what these pioneering survivors can expect as they reach their 50s, 60s and beyond. They're now getting chronic illnesses such as heart disease, diabetes, kidney disease and osteoporosis ? some of the common ailments when anyone gets old. But studies suggest people with HIV may be at higher risk for some of those illnesses, or get them earlier than usual.

"It's almost created a new subspecialty of medicine," Fauci said.

Perhaps the strongest evidence links HIV and an increased risk of heart disease. Some AIDS medications raise that risk. But in research published for the AIDS meeting, scientists at Massachusetts General Hospital uncovered another reason.

They scanned the arteries of people with and without HIV, and found the HIV patients had more inflammation inside their arteries, putting them at risk for the kind of clots that trigger heart attacks. That's even though the HIV patients had their virus well-controlled and weren't that old ? their average age was 52, the researchers reported in the Journal of the American Medical Association.

HIV triggers body-wide inflammation as a person's immune system tries to fight the virus, a process that persists and can quietly damage organs even with good medications, CDC's Fenton said.

HIV is not acting in a vacuum, said Dr. Amy Justice of Yale University, noting that people's histories of smoking, for example, also contribute to inflammation.

But she pointed to data from a Veterans Affairs study that said older people with HIV use more medications for other diseases than HIV-free patients the same age.

At the conference, some older people with HIV lined up to have their photographs made and their personal histories recorded, part of a Web project called "The Graying of AIDS."

It's a chance to be counted, and share knowledge.

"We're so concerned about the youth factor, we forget about the people who've brought us thus far," said Massey, the Maryland woman, who leads an HIV group called Older Women Embracing Life and works with churches to raise HIV awareness.

CDC's Fenton noted that those voices can help other older adults realize they're at risk, when they're getting back onto the dating scene after years of monogamous relationships. Older people don't use condoms as much as younger people.

"We still have this huge issue with stigma so thick you can cut it with a knife," says Massey, who also wants HIV testing to become a routine part of health check-ups. "We have to normalize the conversation."

Gov't stepping up fight against health care fraud

(AP) ? The Obama administration is upping the ante in the fight against health care fraud, joining forces with private insurers and state investigators on a scale not previously seen in an attempt to stanch tens of billions of dollars in losses.

Health and Human Services Secretary Kathleen Sebelius said in a statement Thursday that the new public-private partnership "puts criminals on notice that we will find them and stop them," while Attorney General Eric Holder called it "a critical step forward" against fraud, an endemic problem plaguing programs like Medicare and Medicare as well as private insurance companies.

The agreement is also unusual because it brings the Obama administration and longtime foes in the insurance industry together to tackle a common problem. While carrying out the requirements of President Barack Obama's health care overhaul law, insurers are also lobbying to roll back some of its provisions, such as new taxes on the industry and cuts to private plans offered through Medicare. Obama continues to rail against industry "abuses."

Details of the collaboration remain to be worked out, but the possibilities include sharing information on new fraud schemes as they pop up, using claims data to catch scams such as payments billed to different insurers on the same day for care purportedly delivered to the same patient in different cities, and using computer analysis to spot emerging patterns of fraud.

An industry official familiar with the discussions said the partnership aims to produce tangible results within six months to a year, but that some issues ? including extensive sharing of claims data ? will take longer to work out. Initially, the collaboration will involve sharing of such information as billing codes associated with fraud for different insurers.

"This is about getting stuff done, not about holding meetings," said the official, who declined to be identified because the official was not authorized to discuss the subject in public and spoke on condition he not be named.

Fraud is estimated to cost Medicare about $60 billion a year, and the Obama administration has beefed up the government's efforts to stop it, bringing in record settlements with drug companies for marketing violations as well as using new powers in the health care law to pursue low-level fraudsters with greater zeal.

Yet, although Medicare is becoming a harder target, it's too early to say if the tide has turned.

Some antifraud efforts launched with great fanfare have yet to deliver convincing results. For example, a $77-million computer system unveiled last summer to stop Medicare fraud before it happens had prevented just one suspicious payment by Christmas.

Likewise, the new public-private collaboration could face problems. Privacy advocates may object to extensive scrutiny of claims data, and doctors have traditionally pushed back against routine computerized monitoring of their practice patterns.

A formal announcement of the campaign was scheduled Thursday afternoon at the White House, with top insurance industry officials participating. Supporting the partnership are America's Health Insurance Plans, the leading industry lobbying group, the Blue Cross and Blue Shield Association, and major companies including UnitedHealth Group and WellPoint, Inc. Formal working meetings are scheduled for September.

"The cost of fraud can far exceed what is paid for in falsified claims," said Karen Ignagni, the industry's top lobbyist. "It can cause real harm to patients who are intentionally exposed to radiation, invasive surgeries and medication they do not need, or suffer the consequences of receiving a fraudulent diagnosis."

The analysis of data from Medicare, Medicaid and private health plans will look for suspicious patterns and other evidence that might indicate fraud, White House officials said. A "trusted third party" would comb through the data and turn questionable billing over to insurers or federal investigators.

Officials said those who submit fraudulent claims often do so for both government programs and private insurance plans. Separately, such claims might not raise suspicions, but taken together they could raise a red flag, such as when a doctor bills for more than 24 hours in a day.

Law enforcement organizations taking part in the collaboration include the FBI, the Health and Human Services Inspector General's Office, the Justice Department, and state and private insurance fraud control units.

This view is by no means universal. On Wednesday, as many as 12 million South African school children started the day by singing happy birthday to the man they call ?Tata Madiba.? Tata means father in Mandela?s native isiXhosa language; Madiba is Mandela?s clan name, and a term of adoration for Mandela. Many South Africans of all races celebrated ?Mandela Day? by spending at least 67 minutes in community service, a minute for each year that Mandela served as a member of the ANC.

While some black South Africans express disappointment that Mandela didn?t push for a better deal with the apartheid government, many black South Africans argue that Mandela did a greater good for the country?s future by giving a higher priority to economic growth and stability rather than ?justice.?

Retired Archbishop Desmond Tutu ? who, like Mandela, received the Nobel Peace Prize for his efforts at reconciliation in South Africa ? issued this statement on Mandela?s birthday:

"The greatest gift our nation could possibly give uTata Nelson Mandela for his 94th birthday this week would be to emulate his magnanimity and grace," Mr. Tutu is quoted by the Sowetan newspaper as saying. "Mr. Mandela taught us to love ourselves, to love one another and to love our country. He laid the table so that all South Africans could eat."

However, Oppenheimer did mention that there would be a product transition coming up that was factored into Apple's next-quarter forecasts. iPhone 5 could certainly fit that bill of materials. But so could other devices.

This recent discovery by LED pioneer Shuji Nakamura and his research team at UCSB is an achievement in VCSEL technology that opens doors for higher optical efficiency lasers at greatly reduced manufacturing costs for a variety of applications.

"We have demonstrated working, electrically-injected nonpolar m-plane nitride VCSELs lasing at room temperature, and have shown that such devices are naturally polarization-locked along the crystallographic a-direction of the wurtzite crystal. This is in contrast to the majority of VCSELs, which are typically randomly polarized," said Dr. Daniel Feezell, project scientist with Nakamura's lab. Feezell directed the research effort with Nakamura and Steven DenBaars , Co-Directors of the Solid State Lighting and Energy Center at UCSB , and graduate student Casey Holder. Their findings have been submitted for publication.

"This is the first report of a nonpolar VCSEL, which we believe to be one of the biggest breakthroughs in the field of laser diode technology," explained Nakamura, a professor of Materials at UCSB . "The nonpolar VCSEL has a lot of advantages in comparison with conventional c-plane devices. One major advantage is that the light polarization is locked to one direction. This device could be used for a variety of applications, such as lighting, displays, sensors, and technology that requires energy efficiency and small form-factor."

VCSELs offer advantages over conventional edge-emitting laser technology for some applications. On-wafer testing of VCSEL arrays during the manufacturing process, for example, can save costs compared to edge-emitting lasers that require additional steps before they can be tested. VCSELs exhibit low threshold currents, circular and low divergence output beams, and are easily integrated into two-dimensional arrays.

The nonpolar VCSEL platform also provides high optical gain, which helps to increase optical efficiency of devices. "The nonpolar VCSEL could enable new products and applications, such as pico-projectors for smartphones, mobile cinema, or even automotive lighting," said DenBaars, professor of Materials.

"This breakthrough achievement by our Solid State Lighting and Energy Center leverages UCSB's globally recognized strength in materials science and engineering," commented Rod Alferness, Dean of the College of Engineering at UCSB. "The enhanced laser performance and prospects for significantly improved cost-effectiveness demonstrated is likely to have important impact on future generations of flat panel displays, mobile phones and lighting."

Draft U.N. arms trade treaty full of holes, activists say

UNITED NATIONS (Reuters) - The first draft of a U.N. treaty to regulate the $60 billion global arms trade was slammed on Tuesday by activists as having "more holes than a leaky bucket" as negotiators scramble to reach a consensus by Friday.

"Our concern with this text is that at the moment it has more holes than a leaky bucket," Anna Macdonald, head of arms control at Oxfam, told reporters. "And if these holes are not closed we won't end up with a treaty that saves lives."

After losing the first week of the month-long negotiations to procedural wrangling, delegations from around the world now only have three days left to work on the delayed draft text before a possible vote. The treaty must be approved unanimously, so any one country can effectively veto a deal.

But if a consensus cannot be reached, the treaty may not be doomed. Activists have said nations supporting a stronger pact could then bring a treaty to the 193-nation U.N. General Assembly and adopt it with a two-thirds majority vote.

"The text that leaves this conference must not be the text with these loopholes. It's got to be a decent text even if it goes back to the General Assembly," said Brian Wood, arms control and human rights manager at Amnesty International.

The draft treaty currently says that it would only come into effect after it has been ratified by 65 countries, which some activists say could take up to 10 years. Arms control campaigners say only 30 ratifications should be needed.

"Every major element ... has major loopholes," said Peter Herby, head of the International Committee for the Red Cross arms unit. "There is a very high risk this treaty will simply ratify the status quo, rather than changing the status quo."

"Rather than producing the highest possible international standards for the transfer of all conventional weapons, it would allow many countries to simply continue doing what they're doing," Herby said.

"BUSINESS AS USUAL"

While most U.N. member states favor a strong treaty, activists said they were at times being drowned out in negotiations by objections and disruptions from a minority of states including Syria, North Korea, Iran, Egypt and Algeria.

There are divisions on key issues, such as whether human rights should be a mandatory criterion for determining whether governments should permit weapons exports to specific countries.

Herby said the draft references to humanitarian law were "unlikely to make a great deal of difference in practice."

Macdonald listed several criticisms. He said the range of weapons in the draft treaty needed to be expanded, particularly to include ammunition; the rules governing risk assessments that countries must do before authorizing an arms sale needed to be tightened; and the whole treaty needed to be broadened to cover the entire global arms trade and not just illicit transactions.

The Conflict Awareness Project said that when it came to regulating arms brokers the draft treaty was "so weak and watered down it will give comfort to illicit gun runners."

"The feeble treaty language means business as usual for traffickers who are filling the arsenals of the world's worst human rights abusers," said Kathi Lynn Austin of the Conflict Awareness Project.

The negotiations on the treaty in New York were delayed for the first week by a dispute over Palestinian participation, which was eventually resolved by allowing the delegation to sit at the front of the negotiating hall but without the right to participate as states with voting rights.

Such procedural bickering was typical of the arms trade talks, diplomats say, as countries that would prefer not to have a strong treaty tried to prevent the negotiations from moving forward. In February, preparatory talks on the rules nearly collapsed due to procedural wrangling and other disagreements.

One of the reasons this month's negotiations are taking place is that the United States, the world's biggest arms trader accounting for over 40 percent of global conventional arms transfers, reversed U.S. policy on the issue after Barack Obama became president and decided in 2009 to support a treaty.

But U.S. officials say Washington insisted in February on having the ability to veto a weak treaty.

"We have been making clear throughout our red lines (limits), including that we will not accept any treaty that infringes on Americans' Second Amendment rights," a U.S. official who did not want to be identified said on Tuesday, referring to U.S. domestic rights to bear arms -- a sensitive issue in the United States.

The other five top arms suppliers are Britain, China, France, Germany and Russia.
